1. Acceptance of Terms

By accessing or using BuildRightPros services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Services.

2. Services Description

BuildRightPros provides AI-powered business solutions for contractors, including but not limited to:

  • AI Reception and call answering services
  • Appointment booking and scheduling
  • Lead capture and management
  • Reputation management
  • Marketing automation services
  • Website development and hosting

3. Account Registration and Eligibility

To use our Services, you must:

  • Be at least 18 years old
  • Provide accurate and complete business information
  • Maintain the security of your account credentials
  • Operate a legitimate business in compliance with all applicable laws

You are responsible for all activity that occurs under your account.

4. Pricing and Payment Terms

Setup Fees

A one-time setup fee applies to most services, ranging from $99 to $496 depending on the service and complexity. This fee covers initial configuration, integration, and customization.

Monthly Subscription

Monthly fees are billed in advance on the date you subscribe. Services include:

  • AI Reception Service: $296/month base fee
  • Usage-based fees: Additional charges based on call volume (typically $0.10-0.30 per minute of AI call time)

Payment Processing

Payments are processed securely through Stripe. By providing payment information, you authorize us to charge your payment method for all fees incurred.

Late Payments

Failure to pay on time may result in suspension or termination of Services. A late fee of $25 or 5% of the outstanding balance (whichever is greater) may be applied to overdue payments.

5. Free Trials

We offer a 7-day free trial for AI Reception services. No credit card is required to start the trial. If you choose to continue after the trial period, you will be charged the applicable setup and monthly fees. You may cancel anytime during the trial without charge.

6. Service Level Agreement (SLA)

We strive to maintain 99.5% uptime for our AI Reception services. In the event of service interruptions:

  • Planned maintenance will be announced at least 48 hours in advance
  • Emergency maintenance may occur without notice
  • Service credits may be issued for extended outages exceeding 4 consecutive hours

7. Refund Policy

Setup fees are non-refundable once work has commenced. Monthly subscription fees are subject to our 30-day money-back guarantee for first-time subscribers. See our Refund Policy for complete details.

8. Data Usage and Privacy

Your privacy is important to us. We collect and process data necessary to provide Services as described in our Privacy Policy. By using our Services, you consent to such collection and processing.

Your Responsibilities

  • You retain ownership of all customer data you provide
  • You are responsible for obtaining necessary consents from your customers
  • You must comply with all applicable privacy and telemarketing laws

9. Acceptable Use Policy

You agree not to use our Services to:

  • Violate any laws or regulations
  • Infringe on intellectual property rights
  • Transmit spam, malware, or harmful content
  • Harass, threaten, or harm others
  • Impersonate another person or entity
  • Interfere with or disrupt our Services

Violation of this policy may result in immediate termination of Services without refund.

10. Intellectual Property

All content, features, and functionality of our Services, including but not limited to text, graphics, logos, software, and AI models, are the exclusive property of BuildRightPros and are protected by copyright, trademark, and other intellectual property laws.

Limited License

We grant you a limited, non-exclusive, non-transferable license to access and use our Services for your business purposes in accordance with these Terms.

11. Third-Party Services

Our Services integrate with third-party platforms including:

  • Stripe (payment processing)
  • Cal.com (appointment scheduling)
  • SignalWire (telephony services)
  • Google Calendar and other calendar services

Your use of these third-party services is subject to their respective terms and conditions.

12. Warranties and Disclaimers

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • Services will be uninterrupted or error-free
  • Results obtained from Services will be accurate or reliable
  • Any errors or defects will be corrected

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BUILDRIGHTPROS SHALL NOT BE LIABLE FOR:

  • Indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or business opportunities
  • Cost of substitute services

Our total liability for all claims related to Services shall not exceed the amount you paid us in the 12 months preceding the claim.

14. Indemnification

You agree to indemnify and hold harmless BuildRightPros and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from:

  • Your use of Services
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your customer data or business practices

15. Termination

By You

You may cancel your subscription at any time through your account dashboard or by contacting support@buildrightpros.com. Cancellation takes effect at the end of your current billing period.

By Us

We may suspend or terminate your access to Services immediately if you:

  • Breach these Terms
  • Fail to pay fees when due
  • Engage in fraudulent or illegal activity
  • Abuse or misuse our Services

Effect of Termination

Upon termination:

  • Your access to Services will cease
  • You remain liable for all fees incurred prior to termination
  • We will retain your data for 30 days for retrieval, after which it will be deleted

16. Modifications to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email at least 30 days before taking effect. Your continued use of Services after changes take effect constitutes acceptance of the modified Terms.

17. Dispute Resolution

Informal Resolution

Before filing a claim, you agree to contact us at support@buildrightpros.com to attempt to resolve the dispute informally.

Arbitration Agreement

Any dispute arising from these Terms or Services shall be resolved through binding arbitration in accordance with the American Arbitration Association's Commercial Arbitration Rules. Arbitration shall take place in Salt Lake City, Utah.

Class Action Waiver

You agree to resolve disputes on an individual basis and waive the right to participate in class actions or class arbitrations.

18. Governing Law

These Terms are governed by the laws of the State of Utah, United States, without regard to conflict of law principles. Any legal action must be brought in the state or federal courts located in Salt Lake City, Utah.

19. Entire Agreement

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and BuildRightPros regarding the use of our Services.
